Terms of Service

These Terms of Service form a legal agreement between you and Kaffio (ABN [ABN TO BE ADDED]) (“Kaffio”, “we”, “us”) covering the Kaffio mobile app, business dashboard, and website. By creating an account or using the service you accept these terms. If you do not accept them, do not use the service.

• You must be at least 13 years old.
• Business accounts must represent a lawfully-operating Australian business with a valid ABN.
• You must provide accurate information and keep your account credentials secure.

Kaffio provides digital loyalty tools. Customers earn stamps or points from participating businesses and redeem rewards those businesses define. Rewards, stamp values, deal terms, and expiry dates are set by each business — not by Kaffio. We are not a party to any transaction between a customer and a business.

• You are responsible for activity on your account.
• You must not share your login with others or attempt to access another user’s account.
• You can delete your account at any time from the mobile app (Profile → Settings → Delete Account) or by emailing contact@kaffio.app.

You agree not to:

• Use the service to break any law or infringe anyone’s rights.
• Reverse-engineer, scrape, or otherwise attempt to extract data you are not entitled to.
• Create multiple accounts to obtain duplicate rewards, or attempt to award yourself stamps or points you did not earn.
• Interfere with the service’s security, integrity, or availability.
• Use automated tools (bots, scripts) on the service without written permission.

We may suspend or terminate accounts that breach these terms.

If you operate a business on Kaffio, you additionally agree that:

• You are responsible for honouring any stamp, reward, or deal you publish.
• You will not collect customer data via Kaffio for purposes unrelated to your loyalty program.
• Paid plan fees are charged in AUD and are non-refundable except where required by the Australian Consumer Law.
• You may cancel your plan at any time; access continues until the end of the current billing period.

Kaffio, the Kaffio name, and the Kaffio logo are our property. You may not use them without permission. You retain ownership of content you upload (such as your business logo); by uploading it you grant us a non-exclusive licence to display and distribute it within the service so it can function as intended.

We may change, suspend, or stop offering features at any time. We aim to keep the service running reliably but do not guarantee uninterrupted availability.

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Subject to that, the service is provided “as is” and to the fullest extent permitted by law we exclude all other warranties. Our total liability to you for any claim arising from the service is limited to the greater of (a) the fees you paid us in the 12 months before the claim, or (b) AUD $100.

If you download the Kaffio app from the Apple App Store, you acknowledge that these terms are between you and Kaffio, not Apple, and that Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these terms and may enforce them against you. You confirm you are not in a country subject to a U.S. government embargo and are not listed on any U.S. government list of prohibited parties.

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

We may update these terms. When we do, we will update the “Last updated” date above and, for material changes, notify you in the app or by email. Continued use after a change means you accept the updated terms.
